  • Users aged 16-17 may browse listings for informational purposes ONLY but are strictly prohibited from any trading activities
  • Users under 16 are completely prohibited from using the platform
  • False age representation will result in immediate account termination and potential legal action
  • We reserve the right to request additional age verification documents at any time
  • Trading authority may be suspended pending age verification

Note: Parent, guardian, or supervisor consent does not override these age restrictions for trading activities.

3. User Account and Registration

To access full platform features, users must:

  • Provide accurate, complete, and current personal information
  • Submit valid government-issued identification for verification
  • Maintain the security and confidentiality of login credentials

  • Nude, sexually explicit, or suggestive material of any nature
  • Violence, threats, harassment, hate speech, or discriminatory content
  • Fraudulent listings, scams, misleading information, or deceptive practices
  • Illegal substances, weapons, stolen goods, or prohibited items
  • Copyright infringement, trademark violations, or intellectual property theft
  • Personal information harvesting or unauthorized data collection
  • Spam, bulk messaging, or unsolicited commercial communications
  • Attempts to circumvent platform fees, security measures, or age verification
  • Creating multiple accounts to evade restrictions or suspensions
  • Any illegal, unauthorized, unsafe, or harmful activities

Consequences: Immediate content removal, account suspension or permanent ban, reporting to law enforcement, and potential legal action.

6. Trading and Transaction Rules

All trading activities must comply with the following:

  • Only verified users aged 18 and above may engage in buying, selling, or trading
  • All listings must accurately represent the condition, price, and availability of items
  • Transactions must comply with Kenyan consumer protection laws
  • Users must honor agreed-upon prices, terms, and delivery commitments
  • Disputes should first be resolved directly between parties in good faith
  • Evidence of transactions should be maintained for potential dispute resolution

7. Marketplace Disclaimer and Limitations

Critical Platform Limitations

  • Kirinyaga Online Market does NOT guarantee the authenticity, quality, safety, or legality of goods or services listed on the platform
  • We are NOT responsible for losses, damages, scams, fraud, theft, personal injury, or any negative consequences resulting from transactions between users
  • We do NOT verify the identity, credentials, or trustworthiness of users beyond basic age verification
  • Users engage in transactions entirely at their own risk and discretion
  • Always exercise extreme caution, meet in safe public locations, and verify items before payment

All fees will be clearly disclosed before any charges are incurred. Users are responsible for any applicable taxes on transactions.

All platform content, including but not limited to:

  • Logos, trademarks, service marks, and brand elements
  • Software code, algorithms, and technical infrastructure

Terminated users forfeit access to all platform features and may lose any associated data or listings.

12. Limitation of Liability

Maximum Legal Protection

To the maximum extent permitted by Kenyan law, Kirinyaga Online Market, its owners, employees, partners, and affiliates shall NOT be liable for any:

  • Direct, indirect, incidental, consequential, or punitive damages
  • Lost profits, revenue, data, or business opportunities

Total liability for any claims shall not exceed KES 10,000 or the amount paid to us in the preceding 12 months, whichever is lower.

13. Indemnification

15. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Kenya, including:

  • The Constitution of Kenya, 2010
  • The Consumer Protection Act, 2012

  • The Computer Misuse and Cybercrimes Act, 2018
  • All other applicable Kenyan legislation and regulations

Any legal disputes shall be resolved exclusively in the courts of Kirinyaga County, Kenya.

16. Terms Modifications and Updates

We reserve the right to modify these Terms at any time by:
